According to what NSA and Nintendo said, Yes if ROM Hacking. No if using for Homebrew/Permissive reasons.

Same reason as If you do not have the cartridge, you must delete the copy or copies of ROM within 24 hrs of time. otherwise bye bye computer!!!

ROM hacking isn't illegal AFAIK, not at least in this country. What aspect of it seems illegal to you? The fun part? How about this angle: What would be a more legitimate use of a disassembler?

Furthermore, I don't know where you think it's legal to have a ROM you don't own for 24 hours. Why is that OK? Can you delete it and download it from the piracy website again each 24 hours? Does that apply for all software? Not sure you have any clue what you are talking about whatsoever.

Even if it's not illegal it might be disrespectful to the author.

Heh, it was really a long time ago the last time I heard that old wives' tale, how nostalgic. I don't think there is any such copyright law though, is there?

One could counter-argue that it is disrespectful for the author not to release the original source code by now.

Discussing disassemblers fits this topic. You’re the one that started talking about if it is legal. How about self-sensor your own nonsense instead of shutting down everyone else?
